Welcome to PetThings. These Terms and Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Services"), as well as any purchases you make from us.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access or use our Services.

Throughout these Terms, the following definitions apply:

• "Company," "we," "us," or "our" refers to PetThings.
• "You," "your," or "user" refers to the individual accessing or using our Services.
• "Products" refers to the pet food, treats, supplements, and other items available for purchase through our Services.
• "Content" refers to text, images, videos, audio, graphics, and other material that may be available on our Services.
• "Account" refers to a user's registration with our Services that may be required to access certain features or make purchases.

To access certain features of our Services or to make purchases, you may need to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, outdated, or incomplete, or if we believe you have violated these Terms.

Product descriptions, images, and specifications are provided for informational purposes only and are subject to change without notice. We make reasonable efforts to display the colors and features of our Products accurately, but we cannot guarantee that your device's display will accurately reflect the actual appearance of the Products.

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to modify prices, discontinue Products, or limit quantities at any time. In the event of a pricing error, we reserve the right to cancel any orders placed for Products listed at an incorrect price.

Taxes will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars.

When you place an order through our Services, you are making an offer to purchase the Products. We reserve the right to accept or decline your order for any reason, including but not limited to Product availability, errors in Product or pricing information, or problems identified by our fraud detection systems.

After you place an order, you will receive an email confirmation with your order details. This email confirms that we have received your order, but it does not mean that your order has been accepted or is being processed.

Shipping and delivery dates are estimates only and are not guaranteed. We are not responsible for delays in shipping or delivery that are beyond our control, including but not limited to weather conditions, natural disasters, or carrier delays.

Risk of loss and title for Products purchased from our Services pass to you upon delivery of the Products to the carrier.

We offer a 30-day satisfaction guarantee on most Products. If you are not completely satisfied with your purchase, you may return the unused portion within 30 days of delivery for a full refund of the purchase price (excluding shipping costs).

To initiate a return, please contact our customer service team with your order number and reason for return. We will provide you with a return authorization and instructions for returning the Product.

Products must be returned in their original packaging and in a condition suitable for resale. We reserve the right to deny refunds for Products that have been opened, used, or damaged after delivery, unless the Product is defective or damaged upon receipt.

Refunds will be issued to the original payment method used for the purchase and may take up to 10 business days to process after we receive and inspect the returned Product.

We offer subscription services for automatic delivery of certain Products. By signing up for a subscription, you authorize us to charge your payment method on a recurring basis for the subscription price plus applicable taxes and shipping fees.

You may modify or cancel your subscription at any time by logging into your account or contacting our customer service team. Changes or cancellations must be made at least 3 business days before your next scheduled delivery to take effect for that delivery.

We reserve the right to change subscription prices, applicable taxes, or shipping fees with notice to you. If we change the price of your subscription, we will notify you in advance, and you will have the opportunity to cancel your subscription before the price change takes effect.

All Content included on our Services, such as text, graphics, logos, images, videos, and software, is the property of PetThings or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may access and use our Content solely for your personal, non-commercial use in connection with using our Services. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our express written permission.

The PetThings name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PetThings or our affiliates or licensors. You may not use such marks without our prior written permission.

Our Services may allow you to post, submit, publish, display, or transmit content such as product reviews, comments, or forum posts ("User Content"). By providing User Content, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide, fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that:

• You own or control all rights to the User Content you post
• The User Content is accurate and not misleading
• The User Content does not violate these Terms, applicable law, or the rights of any third party
• The User Content is not defamatory, obscene, offensive, or otherwise objectionable

We reserve the right to remove any User Content at our discretion without notice.

You agree not to use our Services for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include, but are not limited to:

• Using our Services in any way that could disable, overburden, damage, or impair the site
• Using any robot, spider, or other automatic device to access our Services
• Introducing viruses, Trojan horses, worms, or other harmful material
• Attempting to gain unauthorized access to our Services or user accounts
• Impersonating another person or entity
• Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of our Services
• Using our Services for commercial purposes without our express written consent

OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WHILE WE STRIVE TO PROVIDE ACCURATE PRODUCT INFORMATION, WE DO NOT WARRANT THAT PRODUCT DESCRIPTIONS, IMAGES, PRICING, OR OTHER CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE.

IN NO EVENT SHALL PetThings, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT PetThings SHALL NOT BE LIABLE FOR USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

You agree to defend, indemnify, and hold harmless PetThings, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to our Services
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of our Services.

These Terms shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in [County], [State].
